Oh! So, the problem has been known about for decades and not fixed? Broken as the Epstein class intended and bribed the politicians to have happen.
Gen Y stands to be the benefactors of the largest wealth transfer in history, by the way. It won’t be equally distributed, but still.
You think something will pass like that? The Epstein class will have drained it all with the Boomers’ retirement/elderly care. The Millennials won’t get anything from their parents.

4·2 days agoYour linked source only applies to civil matters (think lawsuits for a slip and fall). It even says:
Under Federal Rules of Civil Procedure Rule 37
That basically arises out of the Fifth Amendment, which reads:
No person shall . . . be deprived of life, liberty, or property, without due process of law
In the criminal conrext, the Fourth Amendment rules, which reads:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
All that “probable cause”, “stop and frisk”, and “reasonable suspicion of wrongdoing” stuff arises from the “unreasonable searches and seizures” bit.

4·3 days agoPeople have the rhetoric of turning to the ammo box since the other 3 don’t seem to work anymore, but there doesn’t seem to be much coming about from it. If the rhetoric isn’t actually materializing, then people must be consenting to having their rights taken away. In that case, the ballot box is delivering exactly what the people want.

1·4 days agoMiranda came about in '66. You mention legislation that came about in '52. This means the explanation in Miranda would definitely contemplared and applied to that, especially since the Constitution outweighs legislation.

21·6 days agoCBP takes the position that travelers do not have the right to an attorney during questioning.
Literally untrue. They really need to look at Miranda v. Arizona, 484 U.S. 436, 467 (1965) (“there can be no doubt that the Fifth Amendment privilege [to an attorney] is available . . . in all settings in which their freedom of action is curtailed in any significant way . . .”).
